Homeowners to Meet with Elliott Homes on Proposed Mirabella Condominium Project - 005





Eric King, Folsom City Councilman and Empire Ranch resident, notified me this morning that Empire Ranch and The Parkway homeowners will have an opportunity to meet with an Elliott Homes representative on Wednesday September 21st at 6:30 P.M. The meeting will take place in Hazel McFarland Park at the picnic tables in the NW corner of the park next to Empire Oaks Elementary School.

Over the past week or so, I have had many e-mails from residents stating their full and complete opposition to this project. Many have stated that they do not want any condos on this site – period. Their position is that they want to see a local neighborhood commercial retail center like we were all promised when we bought out homes. I agree completely, and we can, and should make that point loudly and clearly to Elliott Homes, not only at this meeting, but at each and every opportunity we get to speak with City officials.

However, at this point in the Folsom legal process there is ONLY ONE place we can publicly argue our case right now and that is with the Architectural Review Commission (ARC), and as such, the only issues that we can raise are architectural related issues. Once the project gets past the ARC, then it goes on to the Planning Commissioners for their hearing. It is that point that we can address Elliott’s request to rezone from the current Commercial/Retail zoning to Multi-Family zoning. After it gets past the Planning Commissioners and they either approve or disapprove the rezoning request, it then goes before the full City Council for a vote.

The bottom line is that since our first public crack at Elliott’s project is with the ARC, we need to all be on the same page and demand the ARC insist on a maximum of 45 to 50 single story luxury condominiums, 2,000 to 3,000 square feet, with steep pitched roofs, multiple roof lines with dormers, along with a full range of custom upgrades being made available. The complex should also have a clubhouse with pool and a shaded grass area for picnics and family gathering. That way, if we happen to lose the rezoning fight with the Planning Commissioners and it somehow passes a City Council vote, then the worst case will be a beautiful luxury condo complex in our midst.

If we are unable to get a unified voice from enough interested neighbors, then we stand a good chance of losing everything and ending up with 154 units crammed into three story buildings. At least, if we can persuade the ARC to make them single story luxury condos, the people who would be more likely to purchase them would be empty nesters with out any young children at home. Should they end up being 154 units in three story buildings (or even 100 units in two story buildings) targeted toward first time home buyers as Elliott now plans, then there will be families with small children who will be putting an additional burden on an already overcrowded Empire Oaks Elementary School.

People continue to ask me what they can do to help fight this proposed development. The best thing we can all do at this point is print out the attached flyer and petition. Make copies and distribute to every house in The Parkway and Empire Ranch. We must get the world out to every concerned person in the area. If someone is able to distribute to a complete street, please e-mail me the name of the street that has been covered and I will post a list to track our progress.

This meeting that Eric King has arranged is just another opportunity for ALL of us to be heard, not only by Elliott Homes, but by Eric King as well. Hopefully Eric will convey our strong feelings to other City Council members so that when this issue does reach the City Council meeting agenda, they are well poised to defeat the rezoning request.

I understand the Elliott Homes has made some “minor modifications” and is hoping to get community approval before the next ARC meeting, which has yet to be scheduled. This next part is a pure guess on my part, but if I was a betting man, my money would say that Elliott is going to come back with a proposal to limit the row of condos that back up to Smith Way to two story units, with all the other units remaining basically the same. A rough guess is that this would reduce the total number of units down to 142 units instead of 154.

This is still UNACCEPTABLE. It is my firm opinion that we MUST stand united on this point and push publicly and privately for a maximum of 45 to 50 single story luxury condominiums, IF it ends up being rezoned Multi-Family. We must let everyone concerned know that there is NO way a dense condo project with 154 (or 142) units in three story buildings, or even 100 units in two story buildings, belongs in the midst of our beautifully planned communities of single family homes in The Parkway and Empire Ranch! We all moved here because the Master Plan is what it is. DON’T CHANGE IT!

As a closing action item for all of us, print out the flyers from this website. Hand print the announcement about this meeting in the top right corner. Make multiple copies and deliver them to every street you can possibly reach. Again, as always, e-mail me with the streets you cover and I will post a status sheet so we all can see what streets still need flyers. See you at the meeting - bring two or more neighbors. A MASSIVE turnout will send the proper message.

    Thanks Patrick,

    One thing I have heard is that Elliott plans to put the buildings at an angle to those on Smith Way so thet the 2 story end of the large 3 story units will be near Smith Way. In addition they plan to emphasize the final height of their structure isn't much taller than a typical two story home. They also plan to emphasize the trees that they will plant.

    In my mind this does very little. If anything it barely scratches the surface of addressing the "visual intrusion" aspect of city ordinances that mandate that multifamily buildings do not visually intrude on existing homes. The tree suggestion is a joke as it will be 10-20 years before they make a difference. The fact that they still want 3 story's there does nothing to address city ordinances that mandate "The residential design will respect the predominant characteristics of height and massing". We need to hammer down that whatever height their buildings are we need to add 10 feet as they continue to fill it with dirt. And finally the city council approves these master plans. What good are they if all they do is change them a few years down the line. The master plans are as good as toilet paper if they just discard them. The city council needs to save their credibility especially with the master pan that they are currently developing for south of 50. They also need to be reminded that Empire Ranch and the Parkway have a lot of voting citizens and we will be watching them. Elliott may have the money but if need be we can get the city council where it will affect them the most...with our votes the next time around.

    Patrick, thanks for your effort. The website is great and the flyers are a great idea.

    I was wondering if anyone has contacted the school district to see what type of impact this project is going to have on enrollment and traffic safety. I believe Empire Oaks is close to capacity, if not at capacity and I heard there were plenty of Parkway Residents who believed their children were going to attend Empire Oaks, but are now attending Theodore Judah because of capacity problems. Will Elliott disclose this to prospective buyers? More importantly, the safety of the children at the intersection should be of greater concern. That intersection is already a mess in the mornings and the afternoon and this project's current scope will only make it worse.

    I realize these issues aren't in the scope of the ARC, however they should be presented at the informal meeting with Elliott next week and definately in front of the Planning Commission, if it gets that far (hopefully it doesn't).

    I was informed by City staff that a retail project's projected traffic pattern would have a greater affect on the area than a multi family residential project. So it is my opinion to agree with your proposal to keep the site limited to single story condominiums or homes with a lower density than currently proposed.

    I for one feel very stongly NOT to have this Condo development go forward for several reasons that have already been mentioned. In addition,I have 2 daughters that will begin school next fall & I am already concerned with our elementary school being over crowded as it is along with the traffic to & from school. What would happen if the Condos are built..can you amigine the grid lock & over-crowded classes? NO WAY!

    Adding the high density condo to our master plan neighborhood is definitely unfair to the home owners. We are counting on the City of Folsom officials to protect consumers from greedy developer who first make the master plan attractive to lie to home buyers, take their money, then ruin the attractive master plan by adding high density housing.

    The biggest problems of adding high density housing to our neighborhood are:
    1. The architectural visual effect of the high density housing is not desirable.
    2. Increase resident population to over crowd our schools.
    3. The high density cheap condos ruin our neighborhood with exclusive single family houses. This makes our neighborhood less attractive to home owners and home buyers.
    4. We lost the retail area in the master plan that we like.

    If the greedy developer can get away with this, what could prevent them from building high density housing in the areas which allocated to Parks in the master plan? I even have a better suggestion; the Empire Ranch golf course has a lot of space, why not making it into a 9-hole executive golf course, and uses the remaining land to build 3000 high density condos there.

    RUSSELL DAVIS is H. C. Elliott's development manager and sits on the board of the Empire Ranch Home Owner's Association. He is not your friend.

    Russell Davis is the one who needs to know Empire Ranch residents will not be pushed around and manipulated like civil servants and elected representatives at the city hall.

    We are not elected officials or civil servants, we are property owners and we have constitutional rights that can not be purchased or manipulated.
